User Agreement

Version 2.0.0 · In effect since

This User Agreement (the “Agreement”) is entered into between Individual Entrepreneur Nikulin Artem Andreevich, INN 434547133957, OGRNIP 326430000048653 (the “Operator”), and any person using the Polyzon Studio service at https://studio.polyzon.org (the “User”). Paid services are additionally governed by the Public Offer, and the processing of personal data by the Personal Data Processing Policy.

1. Definitions

  • Service means the website https://studio.polyzon.org and its features: generation of images and 3D models using artificial intelligence, the assistant, the OpenSCAD editor, the “3D character” wizard, “Product listing”, free tools, the library, search for ready-made models, and related features.
  • AI Features means features of the Service whose results are produced by artificial intelligence models of third-party suppliers (the “AI Providers”).
  • Tools means the generators and utilities in the “Tools” section that run in the User's browser without AI Providers.
  • Polyzon Account means an account on polyzon.org used to sign in to the Service. Account means the User's data in the Service created at the first sign-in.
  • User Materials means anything the User uploads or enters: descriptions (prompts), photos, images, 3D models, drawings, code, messages to the assistant and to support, and product information.
  • Result means anything the Service creates at the User's request: images, 3D models, code, texts, product listings, calculations, and assistant replies.
  • Tokens means internal accounting units used to pay for paid operations. Tokens are not money, electronic money, or digital currency.

2. Acceptance of the Agreement

2.1. This Agreement is a public offer (Article 437(2) of the Civil Code of the Russian Federation) and a contract of adhesion (Article 428 of the Civil Code). The User accepts it by clicking “Sign in with Polyzon” on the sign-in page, where a note next to the button states that signing in means accepting the Agreement (Article 438(3) of the Civil Code). The Operator keeps a record of the version of the accepted Agreement, the time of acceptance, and the IP address from which it was accepted.

2.2. The Tools are also available without signing in. By using them, a visitor accepts Sections 6, 9, 10, 12, and 14–16 of the Agreement.

2.3. Buying a Token pack is a separate contract on the terms of the Public Offer. With respect to paid services, the offer takes precedence over the Agreement.

2.4. Signing in, restoring access, and managing the Polyzon Account are governed by the documents of polyzon.org. The Service and polyzon.org belong to the same person, the Operator.

3. Age and legal capacity

3.1. The Service is not intended for persons under the age of 14. By signing in to the Service, the User confirms that they are at least 14 years old.

3.2. A User aged 14 to 18 may make payments within the limits set by Article 26 of the Civil Code or with the consent of a legal representative.

3.3. The Operator does not verify age against identity documents. The Account of a person under 14 is deleted at the request of their legal representative or when this fact is discovered.

4. Account

4.1. Signing in is possible only with a Polyzon Account. No separate password is created in the Service; the Operator receives from polyzon.org a pseudonymous identifier and, if the User has allowed them to be shared, the User's name, profile picture, and email address.

4.2. The User undertakes:

  • not to share access to the Polyzon Account and the Account with others;
  • to notify the Operator of any suspected unauthorized access;
  • not to create multiple Accounts in order to receive the welcome Tokens, the free daily limit, or referral rewards again.

4.3. Actions performed through the Account are deemed to have been performed by the User until the User notifies the Operator of unauthorized access.

4.4. The User can end all sessions and delete all Results in the “Account” section. The entire Account can be deleted on request via the “Help” chat or by email to support@polyzon.org sent from the Account's email address. Before deletion, the Operator informs the User of the remaining paid Tokens and offers a refund for them under the offer; a deleted Account and its Tokens cannot be restored.

5. How the Service works and what it does not guarantee

5.1. Results of AI Features are created automatically by the AI Providers' models (in particular, via OpenRouter and Meshy). Such a Result is probabilistic: it may not match the description and may contain errors, distortions, inaccurate dimensions, geometry defects, and incorrect lettering. Similar Results may also be created for other users.

5.2. The assistant is a feature in beta testing. Its replies, calculations, and recommendations may be incorrect and are not professional advice, whether engineering, legal, medical, tax, or other. The User verifies them independently.

5.3. The Tools perform calculations in the User's browser; files uploaded to them are not sent to the server until the User sends a Result to the studio, the library, or the assistant. Estimates of time, weight, cost, strength, clearances, and printability are approximate.

5.4. The search for ready-made models shows models from the polyzon.org catalog and third-party platforms. The rights to them belong to their authors, and the terms of use are set by the original source. The Service does not grant rights to the models found and does not confirm their license, price, safety, or fitness.

5.5. “Product listing” is a tool for preparing images and texts. The User is the seller of the product and the advertiser: before publishing, the User checks that the product information is accurate and that it complies with the Federal Law “On Advertising”, consumer protection legislation, product labeling and mandatory certification requirements, trademark rights, and the marketplace's rules.

5.6. The Operator may change, add, and disable features of the Service, including temporarily suspending AI Features if an AI Provider is unavailable or has changed its terms. Paid Tokens are retained in that case; the User's rights to a refund are determined by the offer.

6. Rules of use

6.1. The User may not:

  • circumvent the Service's restrictions, such as daily limits, rate limits, AI Provider filters, and moderation, including by crafting wording and instructions designed to bypass these restrictions;
  • access other people's data, disrupt the operation of the Service, upload malicious code, or interfere with the Service's program code beyond the cases expressly permitted by law;
  • extract data by automated means, resell access to the Service, or embed it in other services without the Operator's written consent;
  • impersonate another person or create a false impression of a partnership with the Operator.

6.2. It is prohibited to create using the Service, upload to it, or distribute through it materials that:

  • are firearms, gas, air, bladed, or throwing weapons, their main parts, ammunition, explosive devices, silencers, or other parts and devices whose manufacture without a license is prohibited (including under Articles 222–223.1 of the Criminal Code of the Russian Federation);
  • are special technical means for covertly obtaining information, items for consuming or manufacturing narcotic drugs, or forged documents, seals, stamps, forms, banknotes, or postage stamps;
  • contain pornography, sexualized images of minors, or scenes of violence against people or animals;
  • contain Nazi symbols, symbols of extremist and terrorist organizations, calls for extremist or terrorist activity, violence, or suicide, or other information whose distribution is prohibited in the Russian Federation (including under Article 15.1 of Federal Law No. 149-FZ of July 27, 2006 “On Information, Information Technologies and Information Protection”);
  • infringe copyright, rights to trademarks and industrial designs, or other rights of third parties, including copies of other people's models, characters, logos, and branded products made for sale without the right holder's permission;
  • use the image, name, or voice of a specific person without their consent, unless the law provides otherwise (Article 152.1 of the Civil Code), damage anyone's honor, dignity, or business reputation, or mislead about real events and people;
  • are passed off as medical devices, personal protective equipment, children's products, food-contact tableware, or certified or load-bearing products without the confirmations required by law.

6.3. The User is solely responsible for the lawfulness of making, using, and selling printed items.

7. Moderation and measures for violations

7.1. Requests pass through the AI Providers' automatic filters, which may refuse a generation. If a generation is not completed, including because of such a refusal, the Tokens for it are automatically returned to the balance.

7.2. In the event of a violation of the Agreement or the law, upon a substantiated complaint, or at the demand of an authorized body, the Operator may: refuse to fulfill a request, delete Materials or a Result, disable a public link, restrict certain features, or suspend or terminate access to the Account. The measure is proportionate to the violation; for gross or repeated violations, access may be terminated immediately.

7.3. The Operator informs the User of the measure and the reason for it through the Service or by email, unless this is prohibited by law or would hinder an investigation. The User may challenge the measure in the “Help” chat or at support@polyzon.org; a reply is given within 10 business days.

7.4. If access to the Account is terminated, the cost of unused paid Tokens is refunded at the User's request under the procedure set out in the offer. Bonus Tokens are not refunded.

7.5. Information about the User and their actions is provided to government authorities only in the cases and in the manner established by law.

8. User Materials

8.1. By uploading Materials, the User confirms that they:

  • have the right to use them, having created them or obtained the right holder's permission, including for other people's 3D models, logos, photos, and fonts;
  • have obtained the consent of every person shown in a photo, and for a minor, the consent of the minor's legal representative;
  • do not include in descriptions and messages other people's personal data, passwords, or information constituting a trade secret or any other secret protected by law.

8.2. The User grants the Operator a royalty-free, non-exclusive, worldwide license to the Materials for the period they are stored in the Service and until they are deleted from backups, solely for providing the services: to store, reproduce, process, transfer to AI Providers to fulfill a request, create previews, and display them to the User and via a public link if the User has enabled one. The Operator does not use Materials for advertising or for training artificial intelligence models.

8.3. The Operator may use ratings and feedback on the assistant's replies, messages to support, and suggestions to improve the Service without paying any remuneration.

8.4. If third parties or authorized bodies bring claims against the Operator because of the User's Materials or actions, the User compensates the Operator for the resulting losses in accordance with the law.

9. Rights to Results

9.1. The Operator makes no claim to the User's Results. The User may use the Results in any way not prohibited by law, including printing, modifying, and selling printed items, worldwide, for an unlimited period, and without paying remuneration to the Operator, provided the Agreement and third-party rights are respected. The same applies to models created with the Tools.

9.2. Under the laws of the Russian Federation, only a citizen whose creative work produced a result can be its author (Article 1228 of the Civil Code). A Result created without human creative input may not be protected by copyright. The Operator does not guarantee that a Result is protectable, unique, or registrable as a trademark or industrial design, or that it does not coincide with anyone else's protected subject matter.

9.3. An artificial intelligence model may reproduce a resemblance to existing characters, products, logos, and works. Before using a Result commercially, the User checks whether it infringes the rights of third parties.

9.4. A public link to a Result can be enabled only by the User. Anyone who has the link can see the Result, its title, and its description; such pages are closed to search engines. The User may disable the link or delete the Result at any time.

10. Rights to the Service and open-source components

10.1. The rights to the Service's program code, design, texts, generators, databases, and designations belong to the Operator or are used by the Operator on legal grounds. The Agreement does not transfer any rights to them to the User, other than the right to use the Service for its intended purpose.

10.2. The Service uses open-source components under their licenses, including OpenSCAD (GNU General Public License), OpenCascade via replicad-opencascadejs (GNU Lesser General Public License 2.1), Manifold (Apache License 2.0), three.js and replicad (MIT License), and fonts (SIL Open Font License 1.1 and Apache License 2.0). The Operator provides the source code of components licensed under the GNU GPL and LGPL on request sent to support@polyzon.org for three years from the last distribution of the relevant version.

11. Tokens, bonuses, and the referral program

11.1. The cost of each operation in Tokens is shown in the interface before it starts. Prices and terms for buying Tokens are set out in the Public Offer.

11.2. At the first sign-in, the User receives 20 tokens as a gift. Welcome, referral, promotional, and other Tokens received without payment (the “Bonus Tokens”) cannot be exchanged for money and are not refundable.

11.3. Polyzon Plus subscribers receive Tokens under the terms of the Polyzon Plus offer on polyzon.org. Their cost is included in the subscription: money for the subscription is refunded under the Polyzon Plus offer, but there is no separate refund for such Tokens.

11.4. Referral program: a User whose link brought in a new user receives Bonus Tokens equal to 10% of the Tokens bought by the invited user and of the Tokens for each month of the invited user's Polyzon Plus subscription. There are no rewards for oneself, for one's own additional Accounts, or for sham purchases; in case of abuse, the Operator cancels such rewards.

11.5. A referral link may be shared as a personal recommendation: in private messages and on one's own social media pages. Placing it in advertising (paid ads, sponsored integrations, and paid posts by bloggers and in channels) is allowed only with the Operator's approval: such placement constitutes advertising and must be labeled as such (Article 18.1 of the Federal Law “On Advertising”). Sending the link to people who have not consented to receive it is prohibited (Article 18 of the same law).

12. Safety of printing and using models

12.1. Results and Tools are not an engineering calculation, a certification, or a safety assessment. Before printing, the User checks the model in a slicer: scale, units, wall thickness, orientation, supports, and warnings.

12.2. A printed item may have hidden defects, weak layers, and inaccurate dimensions. Do not use untested parts where their failure could cause harm: in load-bearing, stressed, fastening, transport, electrical, gas, and plumbing assemblies, in protective equipment, in medical devices, in contact with food, near heat sources, or in items for children. Such uses require professional assessment, testing, suitable materials, and compliance with mandatory requirements.

12.3. Small parts of printed toys and jewelry are dangerous for children under three. Items for children may be used only under adult supervision.

12.4. Follow the printer and material manufacturers' instructions, ensure ventilation and fire safety, and do not leave a running printer unattended unless the manufacturer allows it.

13. Complaints from right holders and others

13.1. The Operator does not check users' Materials and Results before they are posted and acts as an information intermediary within the meaning of Article 1253.1 of the Civil Code. If a User or a third party believes that material in the Service (including material available via a public link) infringes their rights or the law, they send a notice to support@polyzon.org or by mail to: office 1022, 109 Lenina St., Kirov, Russia.

13.2. The notice must include:

  • the name of the applicant (an individual or an organization) and contact details for a reply;
  • a link to the material or another description that allows it to be found;
  • which right has been violated and what supports this: for intellectual property rights, the protected subject matter and information about the right holder; for images and personal data, the applicant's connection to that information;
  • a document confirming authority if the notice is submitted by a representative.

13.3. Upon a notice of infringement of copyright or related rights that complies with Article 15.7 of Federal Law No. 149-FZ, the Operator removes the material or restricts access to it within 24 hours and notifies the User who posted it. Other notices are reviewed within 10 business days; materials that pose an obvious threat to life and health, involve minors, or are extremist in nature are restricted immediately upon receipt of the notice.

13.4. A User whose material has been removed may submit objections with evidence of their rights. A knowingly false notice makes the applicant liable under the law.

14. Liability

14.1. The Service is provided in the form in which it is available (“as is”). The Operator fixes identified faults within a reasonable time but does not guarantee uninterrupted and error-free operation of the Service and the AI Providers, or the fitness of Results for purposes the User has not communicated.

14.2. The Operator is not liable for: the content of User Materials and the consequences of using Results, including printed items, contrary to Sections 6 and 12; losses arising from checks the User should have performed (Sections 5, 9, and 12); or interruptions caused by the actions of third parties, AI Providers, or telecom carriers, or by force majeure, including decisions of government authorities.

14.3. If the User uses the Service for business purposes (is not a consumer), the Operator's liability is limited to actual damages in an amount not exceeding what the User paid for Tokens during the three months before the breach; lost profits are not compensated.

14.4. The limitations of liability do not apply to an intentional breach by the Operator and do not limit consumer rights established by law, including Law of the Russian Federation No. 2300-1 of February 7, 1992 “On Protection of Consumer Rights”.

15. Changes to the Agreement

15.1. Each version has a version number and a date. The current version is published at https://studio.polyzon.org/en/legal/terms.

15.2. The Operator notifies the User of changes that worsen the User's position at least 10 calendar days before they take effect, in the Service and, if the User's address is known, by email. A User who does not agree with the changes may stop using the Service and receive a refund for unused paid Tokens under the offer. Changes that do not worsen the User's position take effect upon publication.

16. Disputes and governing law

16.1. The Agreement is governed by the law of the Russian Federation.

16.2. Claims are sent to support@polyzon.org or to the mailing address. The Operator responds to a claim within 10 calendar days of receiving it, unless the law sets a different period.

16.3. A consumer may bring an action in a court of their choice in accordance with Article 17 of the Law “On Protection of Consumer Rights”; the pre-trial claim procedure is not mandatory for them. Disputes with a User who is not a consumer are heard, after the pre-trial claim procedure, by the court at the Operator's location.
